This End User License Agreement ("Agreement") is a legal agreement between you and Arcana Audio governing your use of the Trine plugin and related software (the "Software"). By installing or using the Software, you agree to these terms.
Subject to this Agreement and payment of the applicable fee, Arcana Audio grants you a perpetual, non-exclusive, non-transferable license to install and use the Software on up to two (2) computers that you own or control, for your own music production, whether personal or commercial.
The Software is licensed, not sold. Arcana Audio and its licensors retain all right, title and interest in and to the Software, including all intellectual property rights. No rights are granted except those expressly set out here.
The Software validates your license key against our activation service and may record a per-machine identifier to enforce the seat limit. You may deactivate a machine to free a seat. Circumventing activation, or sharing your key, is prohibited.
You may not resell, rent, lease, sublicense, or redistribute the Software or your license key; reverse engineer, decompile or disassemble it except to the extent permitted by law; remove proprietary notices; or use it to build a competing product.
Updates within the same major version are provided at no additional charge. Arcana Audio may, but is not obligated to, provide support, updates, or new versions. Future major versions may be offered as separate products.
A time-limited trial may be offered. The trial is provided for evaluation only and may include limitations or reminders. All terms of this Agreement apply to the trial except the payment and perpetual-license provisions.
If the Software does not work for you, contact us within sixty (60) days of purchase for a full refund. Upon refund, your license terminates and you must remove all copies.
The Software is provided “as is” without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. You assume all risk as to quality and performance.
To the maximum extent permitted by law, Arcana Audio shall not be liable for any indirect, incidental, special or consequential damages, or loss of data, revenue or profits, arising from your use of the Software. Total liability shall not exceed the amount you paid for the license.
This license terminates automatically if you breach it. On termination you must stop using and remove all copies of the Software. Sections 2, 4, 8, 9 and 11 survive termination.
This Agreement is governed by the laws of the jurisdiction in which Arcana Audio is established, without regard to conflict-of-laws principles. If any provision is held unenforceable, the remainder stays in effect.
